{"id":7683,"date":"2016-04-14T13:22:28","date_gmt":"2016-04-14T12:22:28","guid":{"rendered":"https:\/\/www.athome.lu\/blog\/?p=7683"},"modified":"2022-05-11T09:42:59","modified_gmt":"2022-05-11T07:42:59","slug":"mise-location-logement-etat-de-detre-loue","status":"publish","type":"post","link":"https:\/\/www.athome.lu\/blog\/de\/louer\/bailleurs\/mise-location-logement-etat-detre-loue\/","title":{"rendered":"Vermietung: Eine Wohnung, die vermietet werden kann"},"content":{"rendered":"<p><span style=\"color: #000000;\">Rechtsanw\u00e4ltin Claudia Thirion, Anw\u00e4ltin f\u00fcr Immobilienrecht in Luxemburg, bringt ihr Fachwissen \u00fcber praktische Empfehlungen vor dem Abschluss eines Mietvertrags ein<\/span>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"color: #000000;\"><strong>Die Lieferpflicht des Vermieters....<br><\/strong><strong>...einer Wohnung in gutem Pflegezustand<\/strong><\/span><\/h2>\n\n\n\n<p><span style=\"color: #000000;\">Wenn ein Eigent\u00fcmer eine Immobilie zur Vermietung bereitstellt, muss er daf\u00fcr sorgen, dass sich die Immobilie in einem guten Zustand befindet.<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\">Dies bedeutet, dass der Vermieter verpflichtet ist, vor Beginn des Mietverh\u00e4ltnisses die Reparaturen oder Instandsetzungen durchzuf\u00fchren, die erforderlich sind, um das Mietobjekt zu \u00fcbergeben, auch wenn es sich um Reparaturen handelt, die im Laufe des Mietverh\u00e4ltnisses zu Lasten des Mieters gehen w\u00fcrden (Bezirksgericht Luxemburg, 26. M\u00e4rz 1998, Rolle Nr. 56336).<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\">Rechtsanw\u00e4ltin Claudia Thirion erkl\u00e4rt, dass die Parteien durch eine Klausel im Mietvertrag von dieser Regel abweichen k\u00f6nnen. Eine solche Klausel kommt in der Praxis h\u00e4ufig vor, insbesondere wenn die Parteien vereinbaren, dass der Mieter f\u00fcr die Instandsetzung der R\u00e4umlichkeiten zust\u00e4ndig ist.<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\">Wenn der Mieter nicht innerhalb einer angemessenen Frist nach der \u00dcbernahme der R\u00e4umlichkeiten eine Beschwerde einreicht, wird davon ausgegangen, dass der Mieter die R\u00e4umlichkeiten in ihrem Zustand akzeptiert hat. &nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\">Wenn der Mieter feststellt, dass die Mietsache einen Mangel aufweist, muss er daher darauf bestehen, dass der Vermieter sich schriftlich verpflichtet, den Mangel zu beheben.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"color: #000000;\"><strong>.... einer Wohnung mit Mindestsicherheits- und -gesundheitsstandards<\/strong><\/span><\/h2>\n\n\n\n<p><span style=\"color: #000000;\">Die gro\u00dfherzogliche Verordnung vom 25.
