The seller undertakes to reserve a flat or part of a building for the buyer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In particular, it may precede a <strong>off-plan sale (VEFA)<\/strong>. In this type of sale, the buyer becomes the owner as construction progresses. Payments are also made in line with the progress of the work.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The reservation agreement should therefore not be confused with the final deed of sale.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Moreover, the Civil Code provides for this specific contract for the reservation of a property to be built. Any other agreement relating to the reservation of a property is void.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To get a full picture of the process, please also see our <a href=\"https:\/\/www.athome.lu\/blog\/acheter\/immobilier-neuf-luxembourg\/\" data-type=\"link\" data-id=\"https:\/\/www.athome.lu\/blog\/acheter\/immobilier-neuf-luxembourg\/\" target=\"_blank\" rel=\"noreferrer noopener\">guide <\/a>intended for the purchase of a new home.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What should the booking contract contain?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The contract must enable the buyer to clearly understand <strong>what it has in store<\/strong> before paying any money.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the Civil Code, it must, in particular, include key information concerning:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the structure of the building; ;<\/li>\n\n\n\n<li>the quality of the construction; ;<\/li>\n\n\n\n<li>the timeframes for carrying out the work; ;<\/li>\n\n\n\n<li>the nature of the accommodation booked; ;<\/li>\n\n\n\n<li>its location within the building; ;<\/li>\n\n\n\n<li>its price.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The contract must be drawn up <strong>in writing<\/strong>. A copy must also be provided to the purchaser before any payment is made.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before signing, please check that the description matches the property shown by the developer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Please also check the plans, floor area, floor layout and annexes. Any car park, cellar, balcony or terrace must be clearly identified where these features form part of the project.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What security deposit may be required?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The security deposit must not exceed <strong>2 % of the estimated price<\/strong> housing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For a property on offer at <strong>600 000 \u20ac<\/strong>, the maximum deposit would therefore be <strong>12 000 \u20ac<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This deposit must not be paid freely into the developer\u2019s current account. The law provides for a <strong>special account opened in the name of the beneficiary<\/strong>, that is to say, the purchaser\u2019s. The funds remain unavailable until the sale contract has been concluded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This point should be checked before any transfer is made.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Source:<\/strong> <a href=\"https:\/\/legilux.public.lu\/eli\/etat\/leg\/loi\/1976\/12\/28\/n1\/jo?from=0&amp;index=1&amp;size=25&amp;sort=%7B%22field%22%3A%22publicationDate%22%2C%22order%22%3A%22desc%22%7D&amp;utm_source=chatgpt.com\" data-type=\"link\" data-id=\"https:\/\/legilux.public.lu\/eli\/etat\/leg\/loi\/1976\/12\/28\/n1\/jo?from=0&amp;index=1&amp;size=25&amp;sort=%7B%22field%22%3A%22publicationDate%22%2C%22order%22%3A%22desc%22%7D&amp;utm_source=chatgpt.com\" target=\"_blank\" rel=\"noreferrer noopener\">Luxembourg Civil Code<\/a>, Article 1601-13.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Can we get the security deposit back?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Yes, in a number of situations provided for by law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In particular, the deposit must be returned if the final contract is not concluded <strong>due to the seller\u2019s fault<\/strong> within the time limit specified in the preliminary contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A refund is also payable where the final contract differs significantly from the booking.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Civil Code specifically cites three situations:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the final price exceeds by more than <strong>5 % the estimated price<\/strong> ;<\/li>\n\n\n\n<li>a piece of equipment that was planned will not, in the end, be installed; ;<\/li>\n\n\n\n<li>the property has suffered a reduction in value of more than <strong>10 %<\/strong> due to changes in its consistency or the quality of the structures.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In such situations, the claim for a refund must be sent to the seller and the custodian by registered post with acknowledgement of receipt.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What happens if the buyer simply changes their mind?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The person making the reservation is not obliged to go ahead with the purchase. However, withdrawing without falling into one of the categories entitling them to a refund may result in the loss of the deposit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In other words, <strong>\u00abI\u2019ve decided not to go ahead with the purchase after all\u00bb does not automatically mean \u00abI\u2019ll get my deposit back\u00bb<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Luxembourg Consumers\u2019 Union also highlights this point. It therefore recommends that you read the booking terms and conditions carefully before committing to a booking.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Should you sign a preliminary sale agreement after making a reservation?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The process for a property yet to be built differs from that for a property that has already been completed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Guichet.lu reports that a <strong>A preliminary sales agreement is not required to reserve the property<\/strong> prior to the notarised deed. The reservation agreement serves this specific purpose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The next step, therefore, is to draw up the final contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This contract for the sale of a property to be built must be concluded <strong>by notarial deed<\/strong>. The administrative authorisations required for the construction must also have been granted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the case of a VEFA, the deed must, in particular, provide for the <strong>guarantee of full completion of the building<\/strong>. It must also state the price, the payment terms and the delivery time.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How can I check the price before booking?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Don\u2019t just check the amount shown on the contract. Also check whether the price is stated as final or subject to change.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A significant difference between the price quoted at the time of booking and the final contract may affect your commitment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As mentioned earlier, an increase of more than <strong>5 % of the estimated price<\/strong> is one of the situations in which the deposit may be refunded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Next, when signing the final contract, check the price adjustment terms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Guichet.lu points out, in particular, that a rise in the index may allow the developer to apply an increase of <strong>2.5 % in instalments<\/strong> of a building under construction. The contract must clearly state whether the price is subject to review and, if so, under what conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A careful reading of these clauses therefore helps to ensure that one does not base one\u2019s reasoning solely on the initial price.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What should you check before signing?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Before signing a <strong>reservation contract<\/strong>, take the time to check five key points:<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>Is the booked accommodation clearly identified?<\/strong><br>Check the floor area, storey, orientation and any outbuildings.<\/li>\n\n\n\n<li><strong>Are the services described in sufficient detail?<\/strong><br>Take a look at the materials, fittings and finishes that are planned.<\/li>\n\n\n\n<li><strong>Are the price and any changes to it clear?<\/strong><br>Identify what is included and the conditions under which the price may change.<\/li>\n\n\n\n<li><strong>Is the project timetable clearly set out?<\/strong><br>Check the stated timeframes for construction and the final deed.<\/li>\n\n\n\n<li><strong>Are the terms of the deposit in order?<\/strong><br>The amount may not exceed 2 % of the estimated price and must be paid into the account specified by law.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">If any clause is difficult to understand, ask for an explanation before signing. For a major property transaction, you can also seek advice from your solicitor.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What happens after the booking contract?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Once the reservation has been made, the project moves on to the notarised deed of sale.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before this step is taken, the necessary planning permission must have been granted. The final contract then sets out the precise terms of the sale.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In particular, the building plans and a descriptive statement must be attached to the deed. In the case of a co-ownership, the co-ownership regulations are also among the required documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In an off-plan sale, payments are then made in instalments as the building work progresses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The booking is therefore only <strong>the first stage of the contract<\/strong> of buying off-plan. However, where the parties wish to formalise the reservation of the property prior to the deed of sale, the Civil Code provides for this specific agreement. Any other agreement relating to the reservation of the property is void.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Can a booking agreement be signed before planning permission has been granted?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The reservation agreement may be entered into prior to the final deed of sale. However, the contract for the sale of a property yet to be built may only be concluded once the necessary planning permission has been granted. Before making a reservation, you should therefore enquire about the administrative progress of the project and the planned timetable.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What happens if the price rises by less than 5 %?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Exceeding <strong>more than 5 %<\/strong> is one of the cases expressly mentioned in the law as grounds for obtaining a refund of the deposit. A price increase below this threshold therefore does not automatically entitle the customer to a refund on that basis alone. The ULC recommends carefully reviewing the terms of the contract and any other potential changes to the project.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Can the security deposit be paid directly to the developer?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Civil Code stipulates that the deposit must be paid into <strong>a special account opened in the name of the beneficiary<\/strong>. The funds will remain unavailable until the sale contract has been finalised.
