{"id":7974,"date":"2016-06-16T12:33:33","date_gmt":"2016-06-16T11:33:33","guid":{"rendered":"https:\/\/www.athome.lu\/blog\/?p=7974"},"modified":"2022-05-12T11:06:08","modified_gmt":"2022-05-12T09:06:08","slug":"the-rental-selection-tenant","status":"publish","type":"post","link":"https:\/\/www.athome.lu\/blog\/en\/louer\/bailleurs\/la-mise-en-location-la-selection-du-locataire\/","title":{"rendered":"Renting: selecting the tenant"},"content":{"rendered":"<p><span style=\"color: #000000;\">Third and final part of our dossier on renting out a property.<br>In this last part, Claudia Thirion gives us her recommendations about the selection of the tenant and in particular the rules to respect when choosing the candidates.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"color: #000000;\"><strong>Documents to be requested from the prospective tenant<\/strong><\/span><\/h2>\n\n\n\n<p><span style=\"color: #000000;\">When renting, there are three types of proof to be requested by the landlord:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><span style=\"color: #000000;\">copy of a valid identity document&nbsp;<\/span><\/li><li><span style=\"color: #000000;\">certificate of residence for the last domicile&nbsp;<\/span><\/li><li style=\"text-align: left;\"><span style=\"color: #000000;\">copy of employment contract and last salary slip<\/span><\/li><\/ul>\n\n\n\n<p><strong><span style=\"color: #000000;\">Read more:&nbsp;<a href=\"https:\/\/www.athome.lu\/blog\/blog\/la-mise-en-location-les-documents-a-presenter-par-le-proprietaire\/\" target=\"_blank\" rel=\"noopener\">Renting: the documents to be presented<\/a><\/span><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"color: #000000;\"><strong>Prohibition of discrimination&nbsp;<\/strong><\/span><\/h2>\n\n\n\n<p><span style=\"color: #000000;\">The Equal Treatment Act<span style=\"font-size: 10.5px; line-height: 0px;\">&nbsp;(1)<\/span>&nbsp; prohibits in particular any direct or indirect discrimination and determines the criteria of discrimination prohibited in Luxembourg.<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\">There are <strong>direct discrimination<\/strong> where one person is treated less favourably than another in a comparable situation because of racial or ethnic origin, religion or belief, disability, age or sexual orientation <span style=\"font-size: 10.5px; line-height: 0px;\">(2).<\/span><\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\"><u>Example<\/u> The refusal of a landlord to rent his property to a person of foreign origin.<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\">There are <strong>indirect discrimination<\/strong> where an apparently neutral provision, criterion or practice is likely to adversely affect persons on grounds of racial or ethnic origin, religion or belief, disability, age, gender or sexual orientation, unless the practice in question can be objectively justified by a legitimate aim.<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\"><u>Example<\/u> refusing to rent a property on the grounds that pets are not allowed: visually impaired people may be discriminated against by this refusal.<\/span><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p style=\"text-align: justify;\">Discrimination is currently punishable by fines and\/or imprisonment.<\/p><\/blockquote>\n\n\n\n<p><strong><span style=\"color: #000000;\">6 criteria for tenant selection are therefore prohibited:<\/span><\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><span style=\"color: #000000;\">religion or belief<\/span><\/li><li><span style=\"color: #000000;\">disability<\/span><\/li><li><span style=\"color: #000000;\">age<\/span><\/li><li><span style=\"color: #000000;\">sexual orientation<\/span><\/li><li><span style=\"color: #000000;\">the ethnic\/racial origin of a person<\/span><\/li><li><span style=\"color: #000000;\">gender.<\/span><\/li><\/ol>\n\n\n\n<p><span style=\"color: #000000;\">In order to be able to select candidates objectively, it is important to clarify certain selection criteria in writing, together with a precise description of the property.<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\">It will therefore be necessary to specify :<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><span style=\"color: #000000;\">the characteristics of the dwelling, i.e. number of rooms, size, equipment, etc.&nbsp;<\/span><\/li><li><span style=\"color: #000000;\">the state of the dwelling: its accessibility, the work to be done&nbsp;<\/span><\/li><li><span style=\"color: #000000;\">the list of documents to be requested from applicants and possibly the financial resources needed to rent the property.<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"color: #000000;\">Estate agents, by respecting the discriminatory criteria of some landlords, could be punished.
