{"id":10531,"date":"2017-11-15T08:59:59","date_gmt":"2017-11-15T07:59:59","guid":{"rendered":"https:\/\/www.athome.lu\/blog\/?p=10531"},"modified":"2022-06-14T16:52:05","modified_gmt":"2022-06-14T14:52:05","slug":"la-signature-du-compromis-de-vente","status":"publish","type":"post","link":"https:\/\/www.athome.lu\/blog\/acheter\/guides\/la-signature-du-compromis-de-vente\/","title":{"rendered":"La signature du compromis de vente"},"content":{"rendered":"\n<p><span style=\"color: #000000;\">Avant de passer devant le notaire, le vendeur et l\u2019acqu\u00e9reur souhaitent souvent formaliser leur accord par \u00e9crit<\/span> : ils proc\u00e8dent \u00e0 la signature d'un compromis de vente.<br><span style=\"color: #000000;\">Le but est de se mettre d\u2019accord sur le principe d\u2019une vente, en vue de se prot\u00e9ger en cas de changement d\u2019avis de l\u2019une des parties, en attendant le passage chez le notaire.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"color: #000000;\"><strong>Les conditions \u00e0 la signature du compromis de vente<\/strong><\/span><\/h2>\n\n\n\n<p><span style=\"color: #000000;\">L'\u00e9tablissement et la signature d'un compromis de vente sont soumis \u00e0 2 conditions :<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><span style=\"color: #000000;\">le vendeur doit avoir la capacit\u00e9 juridique de vendre le bien, et l'acqu\u00e9reur celle de l'acheter ;<\/span><\/li><li><span style=\"color: #000000;\">la chose et le prix doivent \u00eatre d\u00e9termin\u00e9s.<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"color: #000000;\"><em>\"L\u2019acte notari\u00e9 dress\u00e9 rend opposable aux tiers la convention sous seing priv\u00e9 sign\u00e9e entre les parties. Le non-accomplissement de cette formalit\u00e9 n\u2019enl\u00e8ve en rien le caract\u00e8re d\u00e9finitif et contraignant au compromis de vente duquel on ne peut en principe pas se r\u00e9tracter.\"<\/em><\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\">Au Luxembourg, la signature d\u2019un compromis de vente n\u2019est toutefois pas obligatoire : le vendeur et l\u2019acheteur peuvent tout \u00e0 fait se pr\u00e9senter chez le notaire sans avoir au pr\u00e9alable conclu un compromis de vente.<\/span><br><span style=\"color: #000000;\"> Mais attention au risque pour l'acheteur, car celui-ci pourrait perdre l'option qu'il aurait pu avoir sur le bien.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"color: #000000;\"><strong>L\u2019enregistrement du compromis<\/strong><\/span><\/h2>\n\n\n\n<p><span style=\"color: #000000;\">En principe, les compromis de vente portant sur un immeuble doivent \u00eatre enregistr\u00e9s aupr\u00e8s de l'Administration de l\u2019enregistrement et des domaines. Un non professionnel du secteur immobilier doit pr\u00e9senter le compromis de vente \u00e0 l\u2019administration de l\u2019enregistrement dans le d\u00e9lai de 3 mois \u00e0 partir du jour de la signature.<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\">Mais en pratique, bon nombre de compromis de vente ne sont pas enregistr\u00e9s. Le d\u00e9faut d\u2019enregistrement du compromis n\u2019affecte toutefois pas sa validit\u00e9. <\/span><br><span style=\"color: #000000;\"> Cependant, l\u2019enregistrement permet de s\u00e9curiser l\u2019accord entre vendeur et acqu\u00e9reur en cas de non-respect de l\u2019accord signifi\u00e9 dans le compromis de vente.<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\">Le d\u00e9p\u00f4t d\u2019un compromis aux bureaux de l\u2019Administration de l\u2019Enregistrement et des Domaines entra\u00eene des frais d\u2019enregistrement.
