Celles-ci doivent \u00eatre prises en compte dans le budget, et notamment lors du pr\u00eat immobilier.&nbsp;Voici le d\u00e9tail.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"color: #000000;\"><strong>Frais de notaire<\/strong><\/span><\/h2>\n\n\n\n<p><span style=\"color: #000000;\">Les frais de notaire regroupent l\u2019ensemble des frais li\u00e9s \u00e0 une acquisition immobili\u00e8re, pay\u00e9s entre les mains du notaire.<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"color: #000000;\">Taxes dues \u00e0 l\u2019Administration fiscale<\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"color: #000000;\">Droits d\u2019enregistrement et de transcription<\/span><\/li>\n<\/ul>\n\n\n\n<p><span style=\"color: #000000;\">Le taux normal pour les acquisitions \u00e0 titre on\u00e9reux d\u2019un immeuble (maison, appartement, terrain \u00e0 b\u00e2tir) s\u2019\u00e9l\u00e8ve \u00e0 7%, dont 6% de droits d\u2019enregistrement et 1% de droits de transcription, calcul\u00e9s sur le prix du terrain et des constructions \u00e9ventuellement r\u00e9alis\u00e9es.<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"color: #000000;\">Droits d\u2019enregistrement<\/span><\/li>\n<\/ul>\n\n\n\n<p><span style=\"color: #000000;\">Il existe plusieurs cas en fonction du lieu de domicile et de l\u2019affectation du bien achet\u00e9 :<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"color: #000000;\">L\u2019acqu\u00e9reur domicili\u00e9 au Luxembourg et pr\u00e9voyant d\u2019habiter lui-m\u00eame l\u2019immeuble b\u00e9n\u00e9ficie des droits d\u2019enregistrement et de transcription au taux forfaitaire de 100 \u20ac si ces droits - \u00e0 savoir 7 % calcul\u00e9s sur le montant du terrain et des constructions \u00e9ventuellement r\u00e9alis\u00e9es - ne d\u00e9passent pas le cr\u00e9dit d\u2019imp\u00f4t de 20.000 \u20ac accord\u00e9 par personne (voir ci-apr\u00e8s point D. Bellegenakt) ;<\/span><\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"color: #000000;\">L\u2019acqu\u00e9reur non domicili\u00e9 \u00e0 Luxembourg et pr\u00e9voyant d\u2019habiter lui-m\u00eame l\u2019immeuble devra faire l\u2019avance des droits d\u2019enregistrement et de transcription, mais pourra les r\u00e9cup\u00e9rer par la suite par envoi au notaire d\u2019un certificat de r\u00e9sidence prouvant qu\u2019il est bien domicili\u00e9 dans le logement acquis ;<\/span><\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"color: #000000;\">L\u2019acqu\u00e9reur qui pr\u00e9voit de louer son appartement ne b\u00e9n\u00e9ficie pas d\u2019un cr\u00e9dit d\u2019imp\u00f4t et devra payer l\u2019int\u00e9gralit\u00e9 des droits d\u2019enregistrement et de transcription, \u00e0 savoir 7 % calcul\u00e9s sur le montant du terrain et des constructions \u00e9ventuellement r\u00e9alis\u00e9es.<\/span><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"color: #000000;\">D\u00e9penses du notaire<\/span><\/h3>\n\n\n\n<p><span style=\"color: #000000;\">Ce montant correspond au remboursement des frais \u00e9ventuellement engag\u00e9s par le notaire par rapport \u00e0 l\u2019acquisition immobili\u00e8re, par exemple les frais relatifs \u00e0 la demande d\u2019extraits cadastraux, d\u2019obtention de certaines pi\u00e8ces administratives aupr\u00e8s du syndic de copropri\u00e9t\u00e9, des administrations, etc.<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"color: #000000;\">Les honoraires et \u00e9moluments notariaux<\/span><\/h3>\n\n\n\n<p><span style=\"color: #000000;\">Il s\u2019agit de la r\u00e9mun\u00e9ration du notaire, fix\u00e9e par r\u00e8glement grand-ducal. Elle correspond \u00e0 environ 1 % prix du terrain et des constructions \u00e9ventuellement r\u00e9alis\u00e9es.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"color: #000000;\"><strong>Frais d\u2019hypoth\u00e8que<\/strong><\/span><\/h2>\n\n\n\n<p><span style=\"color: #000000;\">Il s\u2019agit d\u2019une suret\u00e9 r\u00e9elle portant sur un bien immeuble et qui garantit le remboursement de la somme emprunt\u00e9e.<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\">Le notaire est charg\u00e9 de dresser l\u2019acte d\u2019hypoth\u00e8que conventionnelle, ce qui engendre des frais de notaire \u00e0 prendre en compte.<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\">Pour que l\u2019hypoth\u00e8que soit opposable aux tiers (c\u2019est-\u00e0-dire aux \u00e9ventuels cr\u00e9anciers du futur propri\u00e9taire), elle doit faire l\u2019objet d\u2019une inscription dans un des Bureaux des hypoth\u00e8ques au Luxembourg.<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\">Exemple : pour un bien immobilier achet\u00e9 d\u2019une valeur de 400.000.-\u20ac, il faudra compter environ 2.700.-\u20ac de frais d\u2019hypoth\u00e8que (frais d\u2019enregistrement et d\u2019inscription et honoraires du notaire).<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\">En cas de vente du bien immobilier avant le terme de l\u2019emprunt immobilier, le vendeur doit obtenir la mainlev\u00e9e de cette hypoth\u00e8que. Cette formalit\u00e9 n\u00e9cessite un nouvel acte notari\u00e9 et donc des frais suppl\u00e9mentaires.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"color: #000000;\"><strong>Assurance solde restant d\u00fb<\/strong><\/span><\/h2>\n\n\n\n<p><span style=\"color: #000000;\">L\u2019organisme de cr\u00e9dit exige en g\u00e9n\u00e9ral une assurance solde restant d\u00fb qui couvre le solde \u00e0 rembourser en cas de d\u00e9c\u00e8s pr\u00e9matur\u00e9 de l\u2019emprunteur.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"color: #000000;\"><strong>\"B\u00ebllegen Akt\" ou cr\u00e9dit d\u2019imp\u00f4t<\/strong><\/span><\/h2>\n\n\n\n<p><span style=\"color: #000000;\">Afin de diminuer les frais accessoires \u00e0 l\u2019acquisition d\u2019un logement, le gouvernement a introduit un abattement, appel\u00e9 cr\u00e9dit d\u2019imp\u00f4t, sur les droits d\u2019enregistrement et de transcription &nbsp;(aussi appel\u00e9 \"B\u00ebllegen Akt\") pour les acqu\u00e9reurs d\u2019un immeuble \u00e0 des fins d\u2019habitation personnelle.<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\">Ce cr\u00e9dit d\u2019imp\u00f4t est limit\u00e9 \u00e0 20.000-\u20ac par acqu\u00e9reur.
