Il est le seul contrat valide pour r\u00e9server tout ou une partie d\u2019immeuble.<\/span><\/p>\n<h2><strong><span style=\"color: #000000;\">Le contrat de r\u00e9servation<\/span><\/strong><\/h2>\n<p><span style=\"color: #000000;\">Le contrat de r\u00e9servation est \u00e9tabli avant le versement des fonds. Il offre au r\u00e9servataire la garantie que le constructeur lui r\u00e9serve un lot d\u00e9fini. Il permet \u00e9galement au promoteur de s\u2019assurer que le projet qu\u2019il envisage de construire est \u00e9conomiquement et juridiquement r\u00e9alisable.<\/span><\/p>\n<p><span style=\"color: #000000;\">Le contrat de r\u00e9servation reprend toutes les informations concernant le bien r\u00e9serv\u00e9 :<br>\n<\/span><br>\n<span style=\"color: #000000;\"> \u2022 Type d\u2019immeuble<\/span><br>\n<span style=\"color: #000000;\"> \u2022 Prestation<\/span><br>\n<span style=\"color: #000000;\"> \u2022 Date de livraison<\/span><br>\n<span style=\"color: #000000;\"> \u2022 Prix d\u00e9finitif ou r\u00e9visable (dans le cas d\u2019un prix r\u00e9visable, les conditions de r\u00e9vision devront figurer sur le contrat)<\/span><br>\n<span style=\"color: #000000;\"> \u2022 Emplacement<\/span><br>\n<span style=\"color: #000000;\"> \u2022 Date d\u2019\u00e9tablissement du contrat de vente<\/span><\/p>\n<h2><strong><span style=\"color: #000000;\">Le versement des fonds pour r\u00e9server un logement neuf<\/span><\/strong><\/h2>\n<p><span style=\"color: #000000;\">La garantie ne peut exc\u00e9der 2 % du prix pr\u00e9visionnel et est vers\u00e9e sur un compte d\u00e9di\u00e9 au nom du r\u00e9servataire. Les fonds vers\u00e9s sont indisponibles, incessibles et insaisissables jusqu\u2019\u00e0 la date butoir du contrat de r\u00e9servation ou jusqu\u2019\u00e0 la signature du contrat de vente.<\/span><\/p>\n<p><span style=\"color: #000000;\">Les int\u00e9r\u00eats produits durant cette p\u00e9riode seront vers\u00e9s au r\u00e9servataire. Sauf si une clause de d\u00e9dit est int\u00e9gr\u00e9e au contrat, dans ce cas, les int\u00e9r\u00eats sont per\u00e7us par le constructeur.<\/span><\/p>\n<p><span style=\"color: #000000;\">Les fonds peuvent \u00eatre restitu\u00e9s si le vendeur ne tient pas ses engagements en termes de d\u00e9lai (date pr\u00e9vue sur le contrat pr\u00e9liminaire) ou si certains \u00e9l\u00e9ments du contrat d\u00e9finitif diff\u00e8rent du contrat pr\u00e9liminaire (prix de vente sup\u00e9rieur \u00e0 5 % ou qualit\u00e9 impactant n\u00e9gativement d\u2019au moins 10 % sur le prix de revient du bien).<\/span><\/p>\n<h2><strong><span style=\"color: #000000;\">Que se passe-t-il en cas de non-construction ?<\/span><\/strong><\/h2>\n<p><span style=\"color: #000000;\">Il faut savoir que le promoteur n\u2019est pas oblig\u00e9 de construire s\u2019il juge le projet risqu\u00e9. Le contrat de r\u00e9servation sert uniquement \u00e0 assurer le r\u00e9servataire que son lot ne sera pas vendu \u00e0 une tierce personne lorsque la construction sera r\u00e9alis\u00e9e. Si le projet est abandonn\u00e9, le promoteur restitue au r\u00e9servataire le d\u00e9p\u00f4t de garantie. En l\u2019absence de raisons \u00e9conomiques ou juridiques, le promoteur qui annule la construction d\u2019un projet pourra se voir dans l\u2019obligation de verser une somme \u00e0 d\u00e9finir \u00e0 titre de dommages et int\u00e9r\u00eats.<\/span><\/p>\n<h2><strong><span style=\"color: #000000;\">R\u00e9server un logement pendant la construction du b\u00e2timent<\/span><\/strong><\/h2>\n<p><span style=\"color: #000000;\">Le promoteur qui \u00e9tablit un contrat de r\u00e9servation alors que les travaux ont d\u00e9j\u00e0 commenc\u00e9 s\u2019engage \u00e0 terminer la construction et \u00e0 r\u00e9server le lot figurant dans le contrat de r\u00e9servation.
