{"id":6019,"date":"2014-10-02T11:11:12","date_gmt":"2014-10-02T10:11:12","guid":{"rendered":"https:\/\/www.athome.lu\/services\/conseils\/?p=6019"},"modified":"2022-05-11T09:20:15","modified_gmt":"2022-05-11T07:20:15","slug":"achat-sur-plan-les-grandes-etapes","status":"publish","type":"post","link":"https:\/\/www.athome.lu\/blog\/acheter\/immobilier-neuf\/achat-sur-plan-les-grandes-etapes\/","title":{"rendered":"Achat sur plan : les grandes \u00e9tapes"},"content":{"rendered":"\n<p><span style=\"color: #000000;\">L\u2019achat sur plan ou la vente en l\u2019\u00e9tat futur d\u2019ach\u00e8vement (VEFA) consiste, pour l\u2019acheteur, \u00e0 acqu\u00e9rir un bien immobilier \u00e0 construire.&nbsp; <\/span><br><span style=\"color: #000000;\">Les soci\u00e9t\u00e9s immobili\u00e8res proposent aux candidats acqu\u00e9reurs des biens neufs, encore au stade du projet, sur plan ou parfois m\u00eame en visite virtuelle gr\u00e2ce au plan 3D anim\u00e9.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><span style=\"color: #000000;\">R\u00e9servez son bien immobilier sur plan<\/span><\/strong><\/h2>\n\n\n\n<p><span style=\"color: #000000;\">D\u00e8s que vous avez arr\u00eat\u00e9 votre choix sur un bien, vous vous engagerez aupr\u00e8s du vendeur en signant un contrat de r\u00e9servation (contrairement \u00e0 l\u2019achat de biens d\u00e9j\u00e0 construits, vous ne signerez pas de compromis de vente).<\/span><br><span style=\"color: #000000;\"> Ce document&nbsp; doit mentionner diff\u00e9rentes informations comme&nbsp;:<\/span><br><span style=\"color: #000000;\"> - la description du logement (surface habitable approximative, nombre de pi\u00e8ces principales et \u00e9num\u00e9ration des d\u00e9pendances, des pi\u00e8ces de service et des d\u00e9gagements) ;<\/span><br><span style=\"color: #000000;\"> - La qualit\u00e9 de la construction et des mat\u00e9riaux utilis\u00e9s&nbsp;;<\/span><br><span style=\"color: #000000;\"> - le prix pr\u00e9visionnel de vente du bien et les conditions l\u00e9gales dans lesquelles il pourra \u00eatre r\u00e9vis\u00e9 ;<\/span><br><span style=\"color: #000000;\"> - le d\u00e9lai dans lequel l'acte de vente d\u00e9finitif pourra \u00eatre sign\u00e9 devant notaire&nbsp;;<\/span><br><span style=\"color: #000000;\"> - les conditions l\u00e9gales dans lesquelles vous pouvez renoncer \u00e0 votre acquisition et exercer votre facult\u00e9 de r\u00e9tractation.<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\">A ce stade, le d\u00e9lai de livraison de l\u2019immeuble n\u2019est pas une mention obligatoire mais il est conseill\u00e9 de le faire pr\u00e9ciser d\u00e8s la r\u00e9servation afin d\u2019\u00e9viter les mauvaises surprises.<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\">Lorsque le contrat de r\u00e9servation est sign\u00e9, il vous sera demand\u00e9 de verser un d\u00e9p\u00f4t de garantie, effectu\u00e9 \u00e0 un compte ouvert au nom de l\u2019acqu\u00e9reur. Le vendeur, lui, s'engage alors \u00e0 r\u00e9server l'immeuble ou une partie de l'immeuble \u00e0 l'acheteur. Le montant du d\u00e9p\u00f4t en garantie ne peut exc\u00e9der 2 % du prix pr\u00e9visionnel.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"color: #000000;\"><strong>L\u2019acte de vente<\/strong><\/span><\/h2>\n\n\n\n<p><span style=\"color: #000000;\">Le contrat de vente d\u00e9finitif ne pourra \u00eatre conclu qu\u2019\u00e0 partir du moment o\u00f9 les&nbsp;autorisations&nbsp;requises pour la construction auront \u00e9t\u00e9 d\u00e9livr\u00e9es par les administrations comp\u00e9tentes.<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\">A partir de ce moment, le contrat de vente du logement neuf sur plan devra \u00eatre sign\u00e9 devant un notaire. D\u00e8s la signature du contrat, vous devenez propri\u00e9taire du terrain et de ce qui est d\u00e9j\u00e0 construit et devrez payer les travaux au fur et \u00e0 mesure de leur avancement.<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\">L\u2019acte notari\u00e9&nbsp;doit contenir, sous peine de nullit\u00e9, les indications suivantes :<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><span style=\"color: #000000;\">l\u2019identit\u00e9 du propri\u00e9taire du terrain et des constructions&nbsp;<\/span><\/li><li><span style=\"color: #000000;\">la date de la d\u00e9livrance des autorisations administratives et les conditions dont elles sont affect\u00e9es&nbsp;<\/span><\/li><li><span style=\"color: #000000;\">la description de l\u2019immeuble ou de la partie d\u2019immeuble vendu et le degr\u00e9 d\u2019ach\u00e8vement convenu&nbsp;<\/span><\/li><li><span style=\"color: #000000;\">le prix et les modalit\u00e9s de paiement de celui-ci&nbsp;<\/span><\/li><li><span style=\"color: #000000;\">le d\u00e9lai de livraison de l\u2019immeuble&nbsp;<\/span><\/li><li><span style=\"color: #000000;\">et, pour les ventes en l\u2019\u00e9tat futur d\u2019ach\u00e8vement, la garantie de l\u2019ach\u00e8vement complet de l\u2019immeuble.<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"color: #000000;\">En plus de ces indications, le contrat de vente devra comporter en annexe:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><span style=\"color: #000000;\">les plans de construction avec les fa\u00e7ades, les plans des diff\u00e9rents niveaux et un plan-coupe de l\u2019immeuble\u00a0<\/span><\/li><li><span style=\"color: #000000;\">une notice descriptive indiquant la consistance et les caract\u00e9ristiques techniques de l\u2019immeuble, ainsi que les mat\u00e9riaux \u00e0 employer\u00a0<\/span><\/li><li><span style=\"color: #000000;\">et, en cas de construction en copropri\u00e9t\u00e9, le r\u00e8glement de copropri\u00e9t\u00e9.<\/span><\/li><\/ul>\n\n\n<section id=\"section-3-14695\" class=\" ct-section\" ><div class=\"ct-section-inner-wrap\"><div id=\"div_block-4-14695\" class=\"ct-div-block\" ><div id=\"new_columns-7-14695\" class=\"ct-new-columns\" ><div id=\"div_block-8-14695\" class=\"ct-div-block\" ><div id=\"div_block-14-14695\" class=\"ct-div-block\" ><\/div><\/div><div id=\"div_block-9-14695\" class=\"ct-div-block\" ><h1 id=\"headline-11-14695\" class=\"ct-headline\">Quels sont les prix de l'immobilier en ce moment ?<\/h1><div id=\"text_block-12-14695\" class=\"ct-text-block\" >Les prix ralentissent. Les taux d'int\u00e9r\u00eat augmentent. En d\u2019autres termes, le futur acqu\u00e9reur paie au fur et \u00e0 mesure de l\u2019avancement des travaux.<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\"> Les pourcentages pr\u00e9vus par la l\u00e9gislation en vigueur sont&nbsp;:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"text-align: justify;\"><span style=\"color: #000000;\">de 10 % pour le paiement du terrain&nbsp;;<\/span><\/li><li style=\"text-align: justify;\"><span style=\"color: #000000;\">de 15 % \u00e0 l\u2019ach\u00e8vement des fondations, \u00e0 l\u2019exception de celles relatives aux garages et autres d\u00e9pendances s\u00e9par\u00e9es de l\u2019immeuble principal&nbsp;;<\/span><\/li><li style=\"text-align: justify;\"><span style=\"color: #000000;\">de 50 % \u00e0 l\u2019ach\u00e8vement de la derni\u00e8re dalle \u00e0 fournir entre les fondations et la toiture sinon une quote-part proportionnelle \u00e0 l\u2019ach\u00e8vement de chaque dalle \u00e0 \u00e9riger<\/span><\/li><li style=\"text-align: justify;\"><span style=\"color: #000000;\">de 95 % \u00e0 l\u2019ach\u00e8vement de l\u2019immeuble.<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"color: #000000;\">Cela permet au vendeur de disposer de liquidit\u00e9s afin d\u2019acqu\u00e9rir au fur et \u00e0 mesure les mat\u00e9riaux n\u00e9cessaires pour continuer la construction.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"color: #000000;\"><strong>La livraison<\/strong><\/span><\/h2>\n\n\n\n<p><span style=\"color: #000000;\">Apr\u00e8s plusieurs mois d\u2019attente, votre future habitation est enfin pr\u00eate&nbsp;!<em><br><\/em>Lorsque votre logement est en bon \u00e9tat et conforme \u00e0 ce qui a \u00e9t\u00e9 pr\u00e9vu initialement dans le contrat de vente, le vendeur vous convoque pour la livraison.<\/span><\/p>\n\n\n\n<p><span style=\"color: #000000;\"> Avant de prendre possession de votre bien, faites d\u2019abord le tour du propri\u00e9taire, pour constater que tout est bien conforme au contrat et que le logement ne contient pas de d\u00e9faut de conformit\u00e9 ou de vice de construction apparent.<\/span><br><span style=\"color: #000000;\"> Dans ce cas, vous devez imp\u00e9rativement consigner ces imperfections sur le proc\u00e8s-verbal de livraison.
