How much are notary fees in Luxembourg?

How much are the notary fees in Luxembourg? And are you entitled to a tax credit? Two questions that many future homeowners ask themselves. We explain how to calculate your notary fees for buying a property and what they cover.

What do notary fees include?

Notary fees include taxes due to the Public Treasury and the costs of the notary's office.

Taxes

These are registration and transcription fees collected by the notary and paid to the Administration de l'Enregistrement et des Domaines. For the purchase of a flat, a house or a building plot in Luxembourg, they amount to 7% :
- 6% for registration fees
- 1% for transcription costs

The notary's fees

In the Grand Duchy of Luxembourg, the notary's fees are governed by a regulation. They are approximately 1%. This amount covers the costs of the notary's office and the salary of the notary and his staff.
Then, the reimbursement of the notary's fees related to the purchase may be added: land registry extract, surveyor's fees, etc.

How to calculate notary fees in Luxembourg?

The maximum amount of the tax credit is €20,000 per purchaser. That is, for a couple, €40,000. This corresponds to a purchase of €300,000 for a single person and €600,000 for a couple. Beyond this purchase price, the tax credit is no longer applied for the bracket exceeding €300,000 or €600,000.

I buy alone:

For a property worth €500,000, the amount including notary fees is €516,652. The calculation is as follows:
Purchase price: €500,000
Registration fees: €35,000
Bellegen Akt" tax credit: - €20,000
Notary fees: €1,652

We buy together:

For a couple buying a property for €500,000, the notary fees amount to €1,752.
The calculation of the notary fees for the purchase of a property as a couple is :
Purchase price: €500,000
Registration fees: €35,000
Tax credit: - €35,000
Registration fee for the second owner: €100
Notary fees: 1652 €.

Am I entitled to a tax credit?

To be entitled to the tax credit called "Bëllegen Akt", you must meet the following conditions:

- Acquire your property to live in establish your primary residence
- Living in the property within 24 months of purchase
- To live in the property within 48 months if the acquisition is land or a building under construction
- Not to rent out all or part of the accommodation

Important! The notarial deed must contain the following information

- the tax credit application
- a statement that the owner will live in the property
- a note of commitment to declare within 3 months to the tax authorities the letting or resale of the property

To be noted The residence obligation is for a period of 24 months. If during this period the building is rented or sold, the unpaid tax credit amounts must be paid.
