Renting: the documents to be presented
In the first part of this series of articles on renting, we talked about the landlord's obligations regarding the condition of the property when renting it out. In this continuation, Claudia Thirion explains the documents that the landlord must have in order to rent a property.
Part 1: Renting: a dwelling in a state of readiness to be rented
Have the energy performance certificate
Since 1 Januaryer From 1 January 2010, residential buildings (i.e. those with at least 90 % of their energy reference area for residential purposes) are classified according to their energy performance.
The energy performance certificate provides information on the calculated energy requirement of the building and on the CO2 emissions. It provides for energy performance classes ranging from A (the best class) to I (the worst class).
In particular, an energy performance certificate must be issued for any change of owner or tenant in an existing residential building, if the building does not already have a valid energy performance certificate.
Such a certificate must be attached to the rental of a property.
DPreferably have the latest statement of charges available
According to the law, it is the landlord who has to prove that the charges are due and he has to justifyIn the case of a claim for reimbursement, the claimant shall provide proof of the expenses claimed, if necessary by producing invoices and receipts.
In practice, it is the syndic of the condominium who will draw up such an annual statement of charges, on which the landlord can base the advance on charges that he asks the tenant to pay each month.
