Successfully signing your property sale

You have made your visits, and this is it, you have found a serious buyer for your property. But the sales process doesn't stop there. There are still a few steps to go before you receive the money for the property in your bank account.

1. The sales agreement

This is the first step in your commitment to each other: the signature of this document formalises the agreement you are making with the buyer of your property. It precedes the visit to the notary and aims to reassure both parties.

To be valid and protective, the preliminary sales agreement must :

  • Mention the identity of the parties
  • Description of the property
  • The selling price
  • Terms of payment
  • A penalty for non-compliance with the contract
  • Suspensive clauses (such as obtaining a bank loan for the buyer).

Make sure that you provide all the necessary documents to identify the property when you sign the compromis.

2. The visit to the notary

Once the compromise signed and the suspensive clauses (such as obtaining a bank loan) liftedyou can notarise the sale. The notary is a public officer: he is responsible for...

  • check that you are the owner of the property for sale
  • check that you are able to sell it
  • carrying out the procedures for registering the sale with the authorities

If you sell as a you can contact the notary of your choice. Otherwise, your real estate agent will be able to recommend one to you.

💡 Good to know:

In Luxembourg, the registration fees correspond to 7% of the sale price of the property. The Notary fees are 1%. These fees are at the expense of the purchaser. You will not have to pay anything at this stage.

Once the deed of sale has been signed, the buyer can enjoy the property he or she has committed to buying. You will no longer own the property. The payment will be blocked according to the terms agreed in the compromise.

If I sell in particular : to find out more about the clauses of a provisional sale agreement and choose to write it alone (at my own risk) or with the help ofa notary near my home.

If I am selling with an agency: send my agent all the documents relating to to the good property (notarial deed, cadastral plan, energy passport). The real estate agency will be responsible for drafting and signing the preliminary sales agreement, and then for the formalities for signing at the notary's office.
